Disability Discrimination

Employers are legally bound to make accommodations for employees for a wide range of disabilities. Discrimination can occur when an employer denied an employee the measures of protection that state and federal law provide.

It is illegal for an employer to discriminate against qualified individuals with a disability in all phases of the employment process, including recruitment, job application procedures, hiring, firing, promotions, benefits, compensation, job training, and job assignments.

Failure to make a reasonable accommodation for an employee in regards to their disability can include denial of the following:

  • Shorter work week or different work hours
  • Time off for medical appointments
  • Equipment or other accommodations to make job duties possible or to prevent injury or aggravation to existing injuries
  • Adaptation of job duties or procedures
