Reduction in Force, Mass Layoffs, or Plant Closings

Reduction in Force / Layoffs

There are times when there is a legitimate business concern for a company to reduce its staff or go through a mass layoff, often referred to as a reduction in force (RIF). While there is nothing illegal about a RIF, there are times when an employer uses the layoff as a means for discriminating against a certain group of individuals.

Additionally, employers must meet certain requirements under federal and state laws, which require them to notify employees of mass layoffs within certain deadlines.

If you were laid off, or will be laid off because of a RIF or plant closing, you have a reasonable basis for questioning your employer’s selection of employees for termination.
